1. Agreement to Terms

By accessing www.encreators.info or purchasing any service from ENCREATORS SOFTWARE AND MEDIA P LTD ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services Provided

ENCREATORS SOFTWARE AND MEDIA P LTD is a done-for-you faceless YouTube channel production company. Our services include, but are not limited to:

• Niche research and selection from our proprietary database

• Channel branding — logo, banner, channel setup

• Topic research using professional tools

• Scriptwriting, voiceovers, video editing, animations, and thumbnail design

• Upload management, SEO tagging, and scheduling

• Dedicated Channel Success Manager as single point of contact

Services are rendered based on the package purchased:

• Starter: 20 videos / $1,000

• Growth: 45 videos / $2,000

• Scale: 65 videos / $3,000

3. Client Responsibilities

To ensure smooth delivery, clients agree to:

• Provide timely approvals on scripts and thumbnails within 48 hours of submission

• Grant manager-level access to their YouTube channel for upload management

• Respond to communications from their assigned Channel Success Manager within a reasonable time

• Not engage third-party production services for the same channel during the active service period without prior notice

4. Intellectual Property

Upon full payment and delivery of videos, all produced content — scripts, voiceovers, edited videos, and thumbnails — becomes the sole property of the client.

ENCREATORS SOFTWARE AND MEDIA P LTD retains the right to reference produced channels and results as portfolio and case study material unless the client requests otherwise in writing.

5. Payment Terms

All packages require full upfront payment prior to production commencement. Payments are non-transferable between packages.

Invoices are issued via the platform or direct bank transfer as agreed during onboarding.

6. Delivery Timeline

Standard delivery for the first batch of videos begins within 72–80 hours of onboarding completion.

Approximate timelines:

• 20-video package: ~30 days

• 45-video package: ~60 days

• 65-video package: ~90 days

Timelines may vary based on client approval speed and revision requests.

7. Revisions

Each video includes:

• Up to 2 rounds of revisions on scripts

• Up to 2 rounds of revisions on thumbnails

Additional revision rounds beyond this scope may incur supplementary fees communicated in advance.

8. No Guarantee of Results

ENCREATORS SOFTWARE AND MEDIA P LTD guarantees professional quality production and timely delivery.

We do not guarantee specific views, subscriber counts, monetization approval, or revenue outcomes, as these are subject to YouTube's algorithm, policies, and niche competitiveness beyond our control.

Past client results are shared as case studies and are not promises of future performance.

9. Prohibited Use

Clients may not use our services to produce content that:

• Violates YouTube's Community Guidelines or Terms of Service

• Promotes illegal activity, hate speech, or harmful misinformation

• Infringes on third-party copyrights or trademarks

• Is intended to deceive, defraud, or mislead viewers

ENCREATORS SOFTWARE AND MEDIA P LTD reserves the right to terminate service without refund if prohibited use is discovered.

10. Limitation of Liability

ENCREATORS SOFTWARE AND MEDIA P LTD shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to:

• Lost revenue

• Channel demonetization

• Algorithm changes by YouTube

Our total liability to any client shall not exceed the amount paid for the specific package in dispute.

11. Cancellation

Either party may terminate the service agreement with written notice.

12. Refund Policy Summary

Refunds are available before production commences. Once production has started, a tiered refund structure applies based on videos delivered.

13. Governing Law

These Terms of Service are governed by the laws of India.

Any disputes arising from this agreement shall first be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration in Trivandrum, Kerala.

14. Changes to Terms

ENCREATORS SOFTWARE AND MEDIA P LTD reserves the right to update these Terms of Service at any time.

Continued use of our services following any updates constitutes acceptance of the revised terms. Material changes will be communicated to active clients via email.
